Terms of Service

These Terms of Service ("Terms") govern your use of velarisfilms.com and photography or videography services provided by Velaris Films ("we," "us," or "our"). By submitting an inquiry, creating an account, signing a contract, or making a payment, you agree to these Terms.
1. Acceptance of Terms
By using our website or booking our services, you confirm that you are at least 18 years old or have the legal authority to enter into an agreement on behalf of yourself or an organization.
2. Accounts & Security
Some services require the creation of a client account. You agree to provide accurate information and maintain the confidentiality of your login credentials.
You are responsible for activity performed through your account. We may collect and store account-related information, including name, email address, phone number, IP address, and browser/device information for authentication, security, and service improvement.
Account deletion requests may be submitted by contacting us. Requests are reviewed and processed according to applicable laws and our record retention requirements.
3. Our Services
Velaris Films provides wedding, portrait, event, real estate, and related photography and videography services.
Specific services, pricing, deliverables, and expectations are defined in your individual quote, package selection, and signed client contract. If there is any conflict between these Terms and a signed client contract, the signed contract will control.
4. Bookings & Payments
- A booking is confirmed only after a signed contract and required deposit have been received.
- The required deposit is 30% of the total package price and reserves your date.
- The deposit is non-refundable except as described in the cancellation section of these Terms or your signed contract.
- The remaining balance must be paid no later than 3 days before the scheduled event date.
- Payments may be made through Stripe, Cash App, Zelle, cash, or check.
- Manual payments will be recorded and confirmed by Velaris Films.
5. Cancellations & Rescheduling
If a cancellation request is made more than 30 days before the scheduled event date, amounts paid may be eligible for a refund according to the terms of the booking agreement.
Cancellations made within 30 days of the event date are non-refundable because the date has been reserved and may prevent us from accepting other bookings.
Rescheduling requests are considered based on availability and may require additional fees or adjustments. Rescheduling is not guaranteed.
6. Deliverables & Turnaround
Final edited photos and videos are delivered through a private online gallery or another approved delivery method.
Delivery timelines vary depending on the service provided, event size, season, and editing workload. Estimated delivery timelines will be communicated during booking or within the signed contract.
Sneak previews, when provided, are delivered at our discretion and do not represent the complete final gallery.
7. Usage Rights & Copyright
Velaris Films retains all copyright and ownership rights to photographs and videos created during services, as protected under applicable copyright laws.
Clients receive a personal-use license to download, print, and share delivered images for personal purposes. Commercial use, resale, or licensing of delivered images requires written permission from Velaris Films.
Velaris Films will only use client images for portfolio, website, advertising, social media, or promotional purposes when the client has provided explicit permission.
8. Third-Party Services
We use third-party providers to operate our website, process payments, analyze website usage, and deliver services.
- Stripe for payment processing
- Amazon Web Services for storage services
- Google Analytics and Google Search Console for website analytics
- TikTok Pixel for marketing measurement
- YouTube for video hosting and embedding
- Cloudflare for website security and performance
These providers may collect or process information according to their own privacy policies. Velaris Films does not control third-party privacy practices.
9. Client Conduct
Clients and guests are expected to treat our team, equipment, and other vendors with respect.
We reserve the right to stop or end services if there are unsafe conditions, harassment, threats, illegal activity, or abusive behavior toward our team. In such circumstances, payments already made may not be refundable.
10. Liability & Force Majeure
We take reasonable precautions to protect your photographs and videos. However, we are not responsible for circumstances outside our reasonable control, including equipment failure, theft, technical failures, data corruption, illness, accidents, extreme weather, government restrictions, or emergencies.
If we are unable to perform services due to circumstances beyond our control, we will make reasonable efforts to provide a replacement professional, reschedule the service, or provide another appropriate solution.
To the maximum extent permitted by law, Velaris Films shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid by the client for the affected services.
11. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
Any disputes arising from these Terms or our services shall be handled through courts located within Texas, United States.
12. Changes to These Terms
We may update these Terms from time to time. Updated versions will be posted on this page with a revised "Last updated" date.
The Terms in effect at the time of your signed contract will govern that specific booking.
